California Consumer Privacy Act (CCPA) Notice

1. Introduction
This California Consumer Privacy Act (CCPA) Privacy Notice supplements the information in our Privacy Policy and applies solely to California residents. Jobspeaker, Inc. ("Jobspeaker," "we," "us," or "our") adopts this notice to comply with the California Consumer Privacy Act of 2018 (CCPA), as amended by the California Privacy Rights Act (CPRA). Any terms defined in the CCPA have the same meaning when used in this notice.
2. Information We Collect
We collect information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer, household, or device ("personal information"). In the preceding 12 months, we have collected the following categories of personal information from California consumers:
Identifiers
Real name, alias, postal address, unique personal identifier, online identifier, IP address, email address, account name, or other similar identifiers.
Personal Information (Cal. Civ. Code § 1798.80(e))
Name, address, telephone number, education, employment, employment history, and financial information such as billing details.
Protected Classification Characteristics
Age, race, color, ancestry, national origin, citizenship, disability, sex, or other protected classifications, only where voluntarily provided by the user.
Commercial Information
Records of subscriptions, products, or services purchased or considered.
Internet or Other Electronic Network Activity
Browsing history, search history, and information on interaction with our website, application, or advertisements.
Professional or Employment-Related Information
Current or past job history, performance evaluations, skills, certifications, and résumé data.
Education Information
Educational records, degrees, transcripts, and institutional affiliations, as defined in the Family Educational Rights and Privacy Act (FERPA).
Inferences
Inferences drawn from personal information to create a profile about a consumer reflecting their preferences, characteristics, skills, behaviors, and aptitudes.
3. Sources of Personal Information
We obtain the categories of personal information listed above from the following categories of sources: directly from you (when you register, fill out forms, or use our Services); automatically from your device or browser as you interact with our Services; from third parties such as educational institutions, employers, credential verifiers, social networks, and analytics providers; and from publicly available sources.
4. Use of Personal Information
We may use or disclose the personal information we collect for one or more of the following business purposes: to fulfill or meet the reason you provided the information; to provide, support, and develop our Services; to create, maintain, customize, and secure your account; to process transactions and payments; to provide customer support; to send you technical notices and support messages; to send you marketing and promotional communications (where permitted); to personalize your experience; to monitor and analyze trends, usage, and activities; to detect, investigate, and prevent fraudulent transactions and other illegal activities; to comply with legal obligations; and to carry out any other purpose described to you at the time the information was collected.
5. Sharing Personal Information
We do not sell your personal information. In the preceding 12 months, we have not sold any personal information of California consumers. We may disclose your personal information to a third party for a business purpose. When we disclose personal information for a business purpose, we enter into a contract that describes the purpose and requires the recipient to both keep that personal information confidential and not use it for any purpose except performing the contract.
In the preceding 12 months, we have disclosed the following categories of personal information for a business purpose: identifiers; personal information under Cal. Civ. Code § 1798.80(e); internet or electronic network activity; professional or employment-related information; and education information. We disclosed these categories to service providers, employers and educational institutions (as part of our core platform functionality), and as required by law.
6. Your California Privacy Rights
The CCPA and CPRA provide California residents with specific rights regarding their personal information. This section describes your rights and explains how to exercise them.
Right to Know
You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months, including the categories collected, the sources, the business purpose, and the third parties with whom we share it.
Right to Delete
You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records.
Right to Correct
You have the right to request that we correct inaccurate personal information that we maintain about you, taking into account the nature of the information and the purposes for which we process it.
Right to Opt-Out of Sale or Sharing
You have the right to opt out of the sale or sharing of your personal information. As noted above, we do not sell your personal information. However, if our practices change, we will update this notice and provide a "Do Not Sell or Share My Personal Information" link on our website.
Right to Limit Use of Sensitive Personal Information
You have the right to limit our use and disclosure of sensitive personal information (such as precise geolocation, race, or financial account details) to only uses necessary to perform our Services or as otherwise permitted by the CPRA.
Right of Non-Discrimination
We will not discriminate against you for exercising any of your CCPA/CPRA rights. Unless permitted by law, we will not deny you goods or services, charge you different prices, provide a different level of quality, or suggest you will receive a different price or quality of goods or services.
7. Exercising Your Rights
To exercise the rights described above, please submit a verifiable consumer request to us by emailing privacy@jobspeaker.com or writing to us at the address listed in Section 9 below. Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.
You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information, and describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it. We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request.
We endeavor to respond to a verifiable consumer request within 45 days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. We will deliver our written response electronically. Any disclosures we provide will cover only the 12-month period preceding receipt of the request.
8. Data Retention
We retain personal information for as long as necessary to fulfill the purposes for which it was collected, including for the purposes of satisfying any legal, accounting, or reporting requirements. To determine the appropriate retention period, we consider the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure, the purposes for which we process it, and applicable legal requirements.
